Update: No paper leak CBSE (Central Board of Secondary Education) says, According to PTI reports, this news came after 2 days of exam on 5th of may there was a Gap of two days.
Answers to as many as 90 questions in the All India Pre Medical/ Pre Dental Test (AIPMT) 2015 got leaked half an hour before the exam on May 3 through Whatsapp and messages. The government of Haryana has officially cancelled the examination after police arrested 4 people of Rohtak in the case – which included 2 BDS doctors, 1 MBBS student and one other person called Rajesh. It is believed that the mastermind of the AIPMT scam was Roop Kumar Dangi who sent the answer keys to over 200 candidates across India.

According to the sources, MBBS student Ravi Narang was the whistleblower in the AIPMT racket. He was the one to report to the police that a boy had AIPMT answer key with him even before the exam. However, the police arrested Ravi instead of taking action against the real culprits. Only when the case came in media limelight, the police was forced to take action and start investigation.
The candidates who received the answers hailed from various states – including Uttar Pradesh, Rajasthan and Uttarakhand. It is believed that the AIPMT question paper was solved in Rajasthan and was sent to the candidates through high-tech bluetooth devices attached to candidates’ undergarments which were especially from Delhi for the purpose.
Dangi, who is a suspended government employee, is still elusive. The police has been interrogating 9 candidates who said that they had paid Rs 15-20 lakh each to the gang for the paper leak.
About 6.3 lakh students had registered for the AIPMT 2015 exam. The exam was conducted at 106 exam centres.

if the cbse is ready to conduct the exam again then not only me but all the medical aspirants will start to prepare themselves for AIPMT…………but it should be informed to us atleast one or two weeks before the exam so that we have sometime on hand to prepare……………..
I think all students except who got the key in advance or had cheating are happy with re-exam
perhaps its time for cbse to conduct a fair exam …
even i think so…. bcos we actually doesn`t know how many students got the answerkeys in advance. This is like throwing stones at those who worked day and night to score good in the test…there should really be a re-exam

Only those students who could not write the exam well will be happy. Anyway those who had been caught will be banned. so for them a reexam does not matter. And those innocents students who performed well will be badly affected incase of a re-exam. So my opinion is to avoid a re-exam and just debarr those who are found guilty. Its easier to find those people who are guilty from call logs etc.
Nobody knows how many people have got the leaked answer key. this was across 3 states. with the very limited 2300 seats, each mark will ruin the career of many people because of those. To be fair exam should be re conducted.

Please don’t do the reexam and punish only who are involved otherwise so many students who are performed well in the exam on 3rd may 2015 will be struggled.
Please don’t cancel the AIPMT exam by keeping the students mind because the studnes are done wel in the exam is already over they will get punished Please take action only on the accused.

please understand the importance of re exam…..it’s better to write a re-exam rather than being cheated. if you have prepared enough and has done the exam good then why do you worry?,you still can do it good…..
This is the single case got detected. There might be many many more which could not got detected/exposed. This is complete failure of the system. This has affected the future of six lakh students. So, there is no reason to not to conduct the re exam. To protect its own dented reputation & to give justice to innocent students, govt must conduct the re exam. Otherwise aam aadmi will never have faith in the system.

I have every reason to suspect at least two candidates who almost gate crashed into the center, just before the gates were closed @ 10:00 at a center in Mayur Vihar Ph-1 in New Delhi. One of them (who appeared to be 20+) was standing with the crowd of parents and other accompanying persons of the candidates. He suddenly decided to get inside the gates @ 9.55 In fact, some of us wondered why was he standing there and what far he was waiting there. Other one just gate crashed, literally on the run @ 9:59 am. He indeed came on the run out of a society gate, just opposite to the school gate. Hence, in the interest of justice to all students, CBSE must conduct reexamination.

An analysis of the AIPMT 2015 Paper Leak, based on news
reports, comments posted by various persons, past court cases and literature
available on net, for use by interested persons, at their own discretion, for writing letters, filing court cases and
any other action deemed fit to protect the interests of brilliant students.
Parents owe it to their children to
make democratic systems work, and to secure for them a fair examination system
free of taint. Are parents doing their job?
At some stage, courts
may ask the authorities- when the police told you the paper has leaked; when
the photographs of equipment and shops
that sold the equipment etc were on the net; when there was a judgement of the
Apex Court to guide you; when you had precedence before you; when you had the
time and the machinery in place; when you had all the reason to act swiftly and
decisively, what stopped you? But by that time it will be too late to help the
students!

It is most surprising that even
as Haryana Police continues to probe the organized paper leak and alleged
passing on of “answer keys” to some students during AIPMT on May 3,
CBSE rejected reports that the question paper had been leaked and said that the
exam was conducted in a “smooth and fair manner”.
Referring to the media reports regarding the arrests, the board said that it
appears that the issue pertains to use
of unfair means and attempt to cheat by certain unscrupulous elements after
commencement of the paper, which is not correct, as the Police is reported to
have claimed a paper leak before the
exam.
The text of the CBSE press release DATED 07-05-15 as uploaded on a website is
as follows:
“There
have been news reports recently, in certain section of media alleging leakage
of AIPMT paper held on 3rd May 2015. It is informed in the interest of all the
candidates who appeared in this examination and general public that there has
been no leakage of the question paper what so ever. The examination started at
10 AM on 3rdMay 2015 as scheduled. No reports were received prior to the
commencement of the examination, during the examination or after the
examination from any quarter by the Board regarding the leakage as alleged, The
first news report of this nature appeared only on 05th May 2015, after a lapse
of two days.
In
order to conduct a smooth and fair examination the Board had made elaborate
arrangements including the deployment of City Coordinators, Observers,
CentreSuperintendents., Invigilators, Police Personnel at each centre.There
have been no reports of any untoward incidents at any centre reported by any
other or these sources.
On
careful study of the press reports it appears that the issue pertains to the use of unfair means and attempt to cheat by certain
unscrupulous elements after the commencement of the paper. The Police
department of the area is initiating suitable action as per law.
To
alley the doubts of the candidates and general public, it is again reiterated
that CBSE AIPMT 2015 was conducted in a smooth and a fair manner keeping the
sanctity of examination .â€Â
CBSE has relied on news
reports to deny the paper leak, as per the press release. One report quoted
officials as saying that when the answer key has not been prepared, how could
it be leaked? However, from the reports, it is evident that what was leaked was
the question paper, and what was circulated could have been the answer key
prepared by subject experts reported to have been engaged by the gang.
90 answers are reported
to have been circulated before the exam. The paper consists of 180 questions,
of which 90 questions of Biology. It
would take an expert just an hour to prepare an answer key to these 90 questions.
Maybe the paper leaked a few hours before the exam, by which time an answer key
to all 180 questions could not be prepared. If the authorities disclose the answer key transmitted, it would be
open to public scrutiny and the truth would emerge.
Moreover, devices are
reported to have been sold for getting remaining answers on Bluetooth. The CBSE
says there were police personnel at all the centers. However, as almost all
would agree, in most places, the police was not at the point of entry. There
was no frisking or checking for ear plugs. In many places, the single constable
at the centre would not have dared to frisk anyone or even exercise a cursory
check.
There is, thus, no doubt
that there could have been a paper leak in the process of examination. It was
not just an issue
pertaining to use of unfair means and
attempt to cheat by certain unscrupulous elements after commencement of the
paper, as stated in the CBSE press release. It seems to an issue pertaining to widespread use of
unfair means and cheating on an all
India scale , on the basis of paper leak
before the examination. It was a tainted exam.
II.
In The Supreme
Court Of India, Civil Appellate Jurisdiction Civil Appeal Nos. 5675-5677 Of
2007, the Hon’ble Court observed as follows:
‘We are also of the view
that the High Court was in error in holding
that the materials
available relating to leakage of question papers was limited and had no
reasonable nexus to the alleged large scale irregularity. Even a minute leakage
of question paper would be sufficient to besmirch the written test and to go
for a re-test so as to achieve the ultimate object of fair selection.’
The
decision can be googled.
The reports suggest a very active interaction between the
candidates inside the Centres and the ones operating from outside to provide
assistance to those who were inside.
In an operation of such like magnitude, it would be extremely
difficult to even establish conclusively the end beneficiaries even if the best
form of investigation is carried out.
Even
if the CBSE undertakes a process of sifting the tainted from the untainted
ones, it would be a process which may achieve inconclusive results, shots in
the dark and end up giving the benefit to undeserving candidates who go
undetected. It is also not in dispute that there was a single paper common to
all which was of 720 marks. This itself would have created a tilt in balance in
favour of the end users of unfair means
In the instant case, even if the investigation carried out by the police
results in naming the culprits yet the question of the end beneficiaries will
still remain in the realm of ambiguity, and because of this ambiguous
situation, a large number of examinees who actually indulged in unfair means
through abuse of gadgetry, may gain
selection.
As widely reported, in
this case, much more than a minute leakage has taken place, and the direction
of the Apex Court, i.e. ‘Even a minute leakage of question paper
would be sufficient to besmirch the written test and to go for a re-test so as
to achieve the ultimate object of fair selection’, needs to be followed by
the authorities.
III.
At this stage, there is no right to anyone to oppose cancellation. No legal
right is created simply by appearing in an exam.
Once a secure system has been penetrated, and there is no
guarantee as to what further may emerge, it appears best to cancel the exam
before further damage. In 2004, a similar problem arose in AIPMT but was nipped
in the bud by cancelling the exam. In view of the revelations made by the
police, protecting the exam held on 03-05-15 would be akin to defending the
indefensible. It needs to be cancelled keeping in mind the ruling of the Apex
Court as cited. So far, the merit list has not been released. Once the selection/merit list is released,
and further information/evidence on the paper leak is uncovered, a precarious
situation would develop with different parties having different claims, and
examinees selected by dubious means but undetected would perhaps claim their
right legally.
IV. Why it is necessary to act
quickly:
If at a later stage, say after one year, there is concrete evidence that the paper was
leaked, those officers who refused to take proper cognizance of facts at the
point of time when they could have, may be in a very odd position. No doubt any
court would ask, when the police told you the paper has leaked, when the
photographs of equipment and shops that
sold the equipment etc were on the net, when there was a judgement of the Apex
Court to guide you, when you had precedence before you, when you had the time
and the machinery in place, when you had all the reason to act swiftly and decisively,
what stopped you?
Right now no one is blaming anyone. It is a big racket and
beyond control of anybody to prevent. However, by not acting, it has the potential
to become a matter of omission, if not commission.
V.
It is evident that
this could be a situation of conflict of interest.
The
officials responsible for the smooth conduct of the exam would be naturally
inclined to deny any allegations of paper leak, whereas the public interest
demands an impartial view to be taken. In this situation, there is a
possibility of a clash between their self-interest of avoiding
controversy on the one hand and safeguarding public interest on the other.
Needless to mention, the presence of a conflict of interest is independent of
the occurrence of impropriety,
and no aspersion what-so-ever is cast on any public official.
The
decision regarding whether or not there was a paper leak should have been taken
by the Ministry of HRD and NOT by the officers of CBSE.
One may see the recent Apex Court judgement on conflict of interest,
in the IPL case, to understand this point.
VI. Every examinee has a right to a
fair exam.
VII. The CBSE is an instrumentality
of the state. It is obliged to act fairly.
The CBSE is obliged
to act reasonably. It cannot act arbitrarily. Wednesbury’s principle of unreasonableness would apply. Any reasonable
person would say that in such a scenario, the exam should be cancelled.
VIII. Any decision not based on
facts and proper grounds is by definition perverse, and bad in the eyes of law.
The decision of CBSE to treat the
case as a case of use of unfair means and attempt to cheat by certain unscrupulous elements after
commencement of the paper, instead of a case of paper leak before the examination, is not based on proper facts,
nor upon evaluation of available evidence by a higher body. It is a decision
serving the interests of the CBSE itself, and in a conflict of interest
situation, a decision on shaky grounds is totally unacceptable.
IX. The CBSE is acting as a judge in
its own case.
The allegation of the police is of a failure of the exam
system .CBSE has to act in public interest. However, CBSE is itself defending
the culprits and weakening the case. No organization
can be a judge in its own case. A higher
and independent body has to enquire into the issue.
X. Level of proof required to
establish paper leak is that of ‘reasonable proof’. It need not be ‘proof
beyond a shadow of doubt’. ‘Reasonable proof’ is all that is required for
cancellation of an exam. Grievous allegations substantiated by prima facie evidence
suffice. Presence of taint is sufficient to require cancellation of the exam.
The sanctity of an exam is violated by events such as FIR by
the police, recommendation by the police to cancel the exam, arrests of
accused, confessional statements of accused, evidence of organized
dissemination of answers with the help of advanced technology, the active
presence of an organized gang, evidence of answers being sent transmitted
before the exam, confessional statements
that payments were to be made after selection, and so on.
XI. The view of the investigating agency,
i.e. Rohtak Police, needs to be accepted.
If CBSE does not
accept their report, it has to opt for a CBI enquiry to establish the facts. It
is obvious that if a re-test is not conducted, there will be a further enquiry
into the paper leak as well as why the re-test was not conducted despite the
overwhelming evidence.
XII. Non- cancellation of the exam paves
the way for future turmoil:
The case of the police is very strong. There is a strong
likelihood of collection of irrefutable evidence. Even at this stage, the
evidence is very strong and convincing. It is necessary for the court to
intervene and order a higher body to evaluate the evidence and take a reasoned
decision. The manner in which CBSE has based its decision on news reports
without reference to the FIR and other factors shows that the matter cannot be left
to the discretion of CBSE, otherwise the cancellation of exam may take place at
a later stage and delay the process of counselling. After counselling, it may
not be possible to cancel the exam.
Since the concerned body is not taking cogent action in the
matter, it becomes necessary for the court to pass orders in the matter. The test of proportionality is whether
it is more in the public interest to take a re-test, or to go ahead with
admissions unmindful of the consequences if the allegations made by the police
stand proved at a later stage.
Points to ponder:
1.Who is worst hit in the case of a
scam-
Those who performed well are hurt, because they stand to
lose the best colleges.
Those in the middle and lower ranks are the worst hit,
because they move out of the selection list altogether.
2. What is the magnitude of seats
affected in case there is a racket-
The magnitude can be judged from the MP PMT scam. The same
agents would be active, the same channels, the same modus operandi. This time,
as the reports suggest, payment was asked after selection, which indicates the
level of confidence of the scamsters.
3. Should a risk be taken to wait
for the full outcome of the investigation-
No one can say. But
once the result is out and we find deserving students to be out of the list of selection list , it will be
too late.
4. Can one rely on the CBSE
statement in their press release dated 07-05-15-
Certainly not.The full facts are not before them. The
arrested persons have made a number of disclosures. The statements made by the
arrested persons are shocking .It indicates a very well organized, full blown
scam.
5. When same thing happens in other
exams, they get attention and get cancelled-
The examinees in exams like UPPSC( recently cancelled) are
older in age. They can agitate. Here examinees are children. They depend on
parents. Parents are leaving it to destiny. Destiny helps those who help
themselves.
6. What about the investigation-
Police has done their job. Everything has been exposed. Nothing
more can be expected, at least not for now. Further investigations may take
time.
7. What needs to be done-
The CBSE has decided not to treat it as a paper leak.
There is no more news from the police.
Only the courts can now examine the matter for appropriate
relief.
A few more days, and it may be too late.
So far, no one appears to have approached the courts.
A number of petitions should be filed in courts by groups of
parents.
Prayer/petitions can be sent individually to the Department
of HRD, Govt. of India.
